​These general terms and conditions apply to the conduct of workshops by Academy of Fine Art GmbH, Im Atzelnest 3, 61352 Bad Homburg, registered in the commercial register of the Bad Homburg District Court under HRB12952. They are part of the contract for your booking.
The general terms and conditions apply regardless of whether you are a consumer, entrepreneur or merchant.

All agreements made between you and us in connection with the workshop contract arise in particular from these terms and conditions and our written order confirmation (invoice).
The version of the general terms and conditions valid at the time the contract is concluded is decisive.
We do not accept any deviating conditions from the customer. This also applies if we do not expressly object to their inclusion.

Bookings can be made by phone at 06172 9451100, by email at info@akademie-malen-zeichnen.de or via the website www.aofaworkshops.com. Registrations are processed in the order in which they are received. The number of participants for our workshops is limited. Registration via the online registration on the workshop website (www.aofaworkshops.com) is binding.

The contract is concluded when the Academy of Fine Art GmbH accepts it and sends an invoice.

A contract can only be concluded by persons aged 18 or over. If registrations are to be made for younger people, we require the consent of the parents or legal guardian.

Subsidiary agreements that do not correspond to the content of the registration or the service descriptions, as well as changes to the contract, require express written confirmation by the Academy of Fine Art GmbH.

​After registering for the workshop, you will receive an invoice within four working days.
If there are more than 4 weeks until the start of the workshop when you register, you will be invoiced for 10% of the workshop fee. This fee counts as a deposit and secures your workshop place with us. The remaining fee will be sent to you in a separate invoice by email around 5 weeks before the start of the workshop.

If there are only 4 weeks or less left until the start of the workshop from the date you register for the workshop, the entire fee will be invoiced.

However, the workshop place is only reserved for you after we have received the invoice amount. If the invoice amount is not paid to us within one week of the invoice date, we reserve the right to pass the place on to the next interested party.

If payment is not made within the stated payment due date, the Academy of Fine Art GmbH is entitled to withdraw from the contract after issuing a reminder with a deadline and to pass on the additional costs to you by engaging a lawyer.
You are not entitled to offset your claims against ours unless your counterclaims have been legally established or are undisputed.

​According to Section 312g Paragraph 2 No. 9 of the German Civil Code (BGB), there is no right of cancellation for workshop bookings. However, we voluntarily grant the right to cancel the concluded contract without giving reasons within 14 days of registering for the workshop. The voluntarily granted right of cancellation is subject to the condition that the course does not start within 4 weeks of registration.

The cancellation period begins when you register for the workshop. To meet the cancellation period, it is sufficient that you send your notification of exercising your right of cancellation before the cancellation period has expired. The cancellation can be declared in writing or by email to Academy of Fine Art GmbH; Mail: info@akademie-malen-zeichnen.de and must contain a clear declaration of your decision to cancel this contract.

If you cancel a contract, we will refund all payments that we have received from you under this contract within fourteen days of the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you. If the refund resulted in increased processing fees due to international transfers or similar, these will be passed on to you.

​If you are unable to attend a booked workshop, you can rebook to another date free of charge if there are at least 4 weeks or more left until the start of the workshop. In this case, please inform us in writing by email to info@akademie-malen-zeichnen.de. If you would like to withdraw from the contract completely, this is also possible up to 4 weeks or more before the start of the workshop. In this case, however, the 10% workshop fee that was due when you registered will be retained.

Free rebooking within 4 weeks before the start of the workshop is not possible.

If you become seriously ill shortly before the start of the workshop, or if there is an unacceptable reason that makes it impossible for you to attend, please send us the relevant documents immediately, such as a medical certificate or cancellation of your accommodation or flight, etc. After receiving the document, we will give you the opportunity to rebook free of charge.
If you cancel a workshop early or can only attend for a short period, you are not entitled to a refund of partial amounts.

​The Academy of Fine Art GmbH reserves the right to cancel the workshop if there is insufficient workshop participation, the workshop leader is unforeseeably unable to attend or other unforeseeable events such as force majeure. As soon as one of the reasons for cancellation applies, the participants will be informed of this by the Academy of Fine Art GmbH at least 3 weeks before the start of the workshop. Workshop fees already paid will be refunded. Any further claims for damages are excluded.

The Academy of Fine Art GmbH reserves the right to change the location, room and teacher of the workshop or the schedule for operational or personnel reasons. These changes do not entitle the participants to withdraw from the contract or to reduce the fee, provided that the changes are reasonable for them, taking into account the interests of the Academy of Fine Art GmbH.

​Vouchers purchased through the Academy of Fine Art GmbH can be redeemed for all workshops organized by the Academy of Fine Art GmbH. The voucher is valid for three years.
Please note that the invoice for the voucher is due immediately upon receipt. The voucher only becomes valid once payment has been received.
If the voucher is not paid within 14 days of receipt of the invoice, it will be canceled by the Academy of Fine Art GmbH.
The voucher can be transferred and can be redeemed using the voucher number provided. Cash payment is not possible.
If a workshop is cheaper than the voucher balance, the amount remains valid until it is used up.
No refunds will be made.

The Academy of Fine Art GmbH - this also includes its vicarious agents - is liable to you in all cases of contractual and non-contractual liability only in the event of intent and gross negligence in accordance with the statutory provisions for damages or reimbursement of wasted expenses.

In other cases, unless otherwise provided in paragraph 7.3 - we are only liable for breach of a contractual obligation, the fulfillment of which makes the proper execution of the contract possible in the first place and on whose compliance you as a customer can regularly rely (so-called cardinal obligation), and is limited to compensation for foreseeable and typical damage. In all other cases, our liability is excluded, subject to the provisions in paragraph 7.3.

Our liability for damages resulting from injury to life, body or health remains unaffected by the above limitations and exclusions of liability.

​All participants must follow the rules during their stay at the Academy of Fine Art GmbH. Otherwise, the Academy reserves the right to exclude participants from classes. Participants in the training and workshops are asked to arrive on time for the start of the class. If they arrive late, participants may have to wait until the break. This applies in particular to nude drawings with models. Participants are asked to behave considerately and quietly in the training rooms so as not to disturb other participants. The consumption of alcohol or drugs is not permitted. The Academy of Fine Art GmbH is a smoke-free facility. Smokers are only allowed to smoke in the designated areas outside the building and are responsible for keeping the premises clean and free of cigarettes. The electronic devices in the kitchen must always be kept clean and well maintained. This applies in particular to the fully automatic coffee machine. Participants who use it must ensure that there are sufficient coffee beans, milk and sugar. Respectful interaction with one another is expected for a positive atmosphere. Suggestions, messages or criticism should be discussed with the responsible workshop leader or the management of the Academy of Fine Art GmbH.

The Academy of Fine Art GmbH reserves the right to postpone or cancel events for reasons that are not the responsibility of the Academy. Participants will be informed of this in good time.
During the workshops and events, photos and, if necessary, videos will be taken by the Academy of Fine Art GmbH for advertising and documentation purposes. By registering, participants agree that their images in which they can be seen may be used. If this is not desired, the participant must notify us in writing. All intellectual property rights to the materials provided during training or in workshops are held by the Academy of Fine Art GmbH. Copying these materials in whole or in part is strictly prohibited and will be prosecuted in the event of a violation. Photos and videos taken by participants within our premises may not be published or used in any other way without the prior written permission of the Academy of Fine Art GmbH. Working documents and computer software used are protected by copyright. Copying or passing on to third parties is only permitted with the prior consent of the copyright holder. Materials provided may only be used for private purposes. Use of the workshop materials for commercial purposes is not permitted.

The Academy of Fine Art GmbH reserves the right to exclude participants from further participation in special cases, such as late payment, disruption of the event or operational processes, non-compliance with the house rules, etc.
The participants' data will be stored and used by the Academy of Fine Art GmbH exclusively for the purpose of organizing the event.

Ancillary agreements must be in writing to be valid. If individual clauses of these terms and conditions are invalid, the validity of the remaining clauses remains unaffected.
Unless otherwise stated, the workshops will take place on the premises of the Academy of Fine Art GmbH, Im Atzelnest 3, 61352 Bad Homburg von der Höhe. The law of the Federal Republic of Germany applies to all legal relationships between the Academy of Fine Art GmbH and the participants.

The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you are a consumer and have your habitual residence in another country at the time of your booking, the application of mandatory legal provisions of this country remains unaffected by the choice of law made in sentence 1.

If you are a merchant and have your registered office in Germany at the time of the order, the exclusive place of jurisdiction is the registered office of the Academy of Fine Art GmbH, Bad Homburg. Otherwise, the applicable statutory provisions shall apply to local and international jurisdiction.
